When a Legal Holiday falls on Sunday, It is Observed the Next Day

Most people know to call three working days before you dig, but what’s a working day? Any day other than Saturdays, Sundays and legal holidays is considered a working day. What happens if a legal holiday falls on a weekend?

July 4, 2004 will fall on a Sunday, and according to state statute, if a legal holiday falls on a Sunday, it shall be observed on the following Monday.  So July 5, 2004 will be a legal holiday.

If a legal holiday falls on a Saturday, it is observed on that Saturday.  The only time when the observation of a holiday changes is when that holiday falls on a Sunday.

This same issue will come up again during the 2005 holiday season.  December 25, 2005 and January 1, 2006 both fall on Sundays and will be observed on the following Mondays.

It is important to note that Diggers Hotline does not decide which legal holidays are observed or when to observe them; both are dictated by state statute.
